SALE TERMS
These are the sale terms that will apply when you purchase products through www.itis01.ovh. FILALTO SAS is a french registered company at the french « REGISTRE DU COMMERCE ET DES SOCIETES » of BORDEAUX under reference B 750 390 551, based 89 rue Judaïque 33000 BORDEAUX, represented by Madame Cécile NEGRIER.
INTRODUCTION
FILALTO uses wool from Alpaca and Baby Alpaca (animal living in the wild at 4500 metres above sea level in the Andes) direct from Peru and Bolivia. Suppliers were selected in Bolivia, for the quality of their wool, their skilled craftsmanship and their commitment to work in a traditional way, with respect to local traditions. The FILALTO products are mostly created in France and manufactured in Bolivia with great attention to quality at every stage of production. All are either made of 100% baby Alpaca or 100% Alpaca. Building on the success of its products, FILALTO has now introduced its online store on Filalto.com.
APPLICATION OF TERMS
These terms and conditions apply to the contract that the CUSTOMER enters when purchasing FILALTO products on the website. Please, read the terms and conditions carefully and make sure you understand them before ordering any products from our website. Anyone making a purchase on the WEBSITE is irrefutably presumed to have read and accepted these terms by clicking “I agree” button. To purchase products on the website you must be at least 18 years old.NETWORK AND ACCESS TO THE WEBSITE
Access to the website requires a connection to the Internet. FILALTO is not responsible for the problems linked with network access. Access to FILALTO.COM is possible at all the time from any device connected to the Internet with a WEB browser, from any place in the world.SECURITY
To buy FILALTO products, CUSTOMER should create an account by filling in a form with adequate information. He must choose a password that needs to be entered each time he connects to his account that he agrees to keep secret. He is responsible for its confidentiality. It can be changed as desired by accessing the "YOUR ACCOUNT" page. If CUSTOMER loses his password, or if CUSTOMER’s password is used without its authorisation, CUSTOMER shall immediately inform FILALTO. To enable secure access again to its account, without delay, CUSTOMER should ask FILALTO to immediately renew its password or CUSTOMER can renew it by himself. FILALTO is not responsible for the loss of the username and password of the CUSTOMER and any illegal use that may be made with it. Access to the site may be temporarily unavailable mainly for maintenance reasons.EQUIPEMENTS PROTECTION
CUSTOMER is responsible for the protection of his material equipment and his own data. FILALTO is not responsible for any damage caused to the equipment and /or data via the INTERNET network or by other means.PRODUCTS
The images of the products on our website are for illustrative purposes only. FILALTO cannot guarantee that CUSTOMER’s computer colour display reflects accurately the colour of the products. Products colours may vary slightly from those images. According to Article L.111 -1 of the French Consumer Code, CUSTOMER should read the description of their essential characteristics before confirming a purchase. CUSTOMER should examine carefully the description of the product, and contact FILALTO (contact@filalto.com) for more details on the product in case of doubt.PURCHASE ORDER
To buy products, CUSTOMER must be 18 years or over and have legal capacity. CUSTOMER should fill the forms with the information required for registration and validation of the order. After selecting a product, the cost of transport is indicated and is added to the product price. FILALTO is not responsible for mistakes made by CUSTOMER when filling the information forms necessary for the process of his order (for instance: wrong address, wrong name, wrong quantity, wrong product, etc...). ORDER PROCESS
All our packages are prepared within 24 hours to 48h following your order except Saturday, Sunday and bank holidays.Any product ordered on the website is delivered to the address specified by customer in the form filled during the ordering process.
FILALTO can deliver customers throughout the world and shipping costs will vary according to the zone where customer wants the products to be delivered, the mode of delivery (at home or in a pick up point delivery). 5 shipping zones are identified.
The cost of shipment will appear automatically on the customer order before a product is purchased, shipping rates are as follows:
SHIPMENT FEES
France : free delivery on orders over 75€.7,50€ for home delivery via colissimo and 4,90€ via pick up point delivery.
Europe, Switzerland and DOM TOM : Free delivery on orders over 200€
15€ for home delivery via colissimo and 12€ via pick up point delivery.
Eastern Europe, Maghreb and Norway : Free delivery on orders over 250€
20€ for home delivery via colissimo.
Canada, USA, Africa : Free delivery on orders over 500€
25€ for home delivery via colissimo
For all other countries and Asia : 35€ for home delivery via colissimo.
Customer will make inquiries and bear all expenses related to the custom duties and taxes applied by the authorities of his country.
FILALTO is not responsible for any risk associated with transport of the packages after they have left the storage facilities of the company. In case of dispute or litigation, only transport documents presented by FILALTO will be considered as evidence. FILALTO is taking exceptional care to pack its products to prevent spoilage. Upon receipt of the package, CUSTOMER is required to check the product conformity and the quality of its condition. If CUSTOMER finds an alteration of the product condition or if the product is not the one he purchased, he must either refuse delivery or issue written reserves dated and signed with the carrier. Otherwise, he is presumed to have received goods in conformity with the order.
RETURNS AND REFUNDS
You are legally entitled to a maximum of 14 days from the day of receipt of your package to return your products. Only products in their original conditions (with packaging and product unworn, unaltered, unwashed ...) will be refunded. Otherwise, the package will be returned to the customer.To make a return, please include a copy of the invoice with the returned product and indicate on the invoice or separately the reason of the return : problem of size, color, cut…Send your package to the following address and remember to ask post office or carrier for proof of DELIVERY:

Once we receive your package, we will send you an email to inform you that it arrived safely and in good condition.
How and when will I receive the amount of my refund ? We will refund you the amount (including VAT) of the items returned, excluding shipping costs, within 10 days. The refund method will be the same as the payment method used for your order.
Filalto cannot be held liable for any packages that could be lost by your shipping company.
STOCK
The products available for sale may vary according to stock. Purchases are therefore only valid if products are available in stock. If CUSTOMER buys a product while the stock is exhausted and if FILALTO is not able to fulfil the order, CUSTOMER will be offered by FILALTO the ability to amend the order or to be reimbursed for the purchase.Delivery time mentioned on the website is provided as an indication only for products available in stock at the completion of the purchase's process. The delivery time runs from the date when product is shipped. The client acknowledges being informed that FILALTO's products are manufactured using traditional methods and their availability is therefore likely to vary because of their mode of production.
RATES
Product's prizes are in euros (€) and all taxes included. The Value Added Tax (VAT) applicable to FILALTO products is set at 20% and automatically appears in the final basket of the CUSTOMER. The products sold by FILALTO remain its entire property until full payment is fulfilled. FILALTO reserves the right to change the price on his website without prior notice.SPECIAL OFFERS
FILALTO rewards the loyalty of its CUSTOMERS. Once CUSTOMER has reached 500 € of purchase (including taxes) over a period of one year, CUSTOMER receives a promotional code by email which he can use on his next purchase. This offer cannot be combined with any other discounts and may be used only once during the calendar year.PAYMENT TERMS
Products are paid after validation of the purchase order by the customer. Payment can only be processed by credit card (Visa, Mastercard, American Express) securely (FILALTO uses CYBERPLUS 3D SECURE Banque Populaire system). Only data recorded by the payment system of Banque Populaire may be used to prove the existence of a financial transaction conducted on site. FILALTO keeps the entire property of the goods until full payment of the price is completed. If FILALTO has legitimate doubts concerning a transaction made on the WEBSITE, it reserves the right to cancel the transaction and not ship the goods concerned. It will then inform the customer by email. FILALTO can not be held responsible of the payment cancelation.TRANSACTION VALIDATION
In accordance with Article 1369-5 of the French Civil Code, after checking the details of the order and the total price and after correcting any errors in its formulation, CUSTOMER is deemed to have read the terms and conditions and accepted them when the payment is made. FILALTO acknowledges receipt of the order received without undue delay and by electronic means. The order, the confirmation of the offer acceptance and the acknowledgment of receipt are deemed received when CUSTOMER whom it is addressed may have access to it. Any event which does not allow the finalization of the payment of the transaction automatically cancels the order.ACT OF GOD
In accordance with Article 1148 of the French Civil Code, any breach of any of the obligations of this agreement caused by an act of God, as traditionally admitted by the case law of French Court of Cassation exempts FILALTO from liability. If such an event occurs, and if FILALTO cannot fulfil the order, it shall inform CUSTOMER by any means as soon as possible. Any suspension of obligations or delay shall in no way be a cause of liability due to non-performance of the obligation in question nor induce the payment of damages or penalties.PERSONAL DATA
Madame CECILE NEGRIER is in charge of the treatment of data that are processed in the website. The information collected is used for the good process of orders and also for the establishment of a customer file. The recipient of the data is only FILALTO. This contract is a distance contract between a consumer (CUSTOMER) and professional (FILALTO). The CUSTOMER can benefit from the Article L121-20 of the French Consumer Code which gives him the right of withdrawal within 14 days after the order has been confirmed on line. This period shall run from the day of receipt by the CUSTOMER of FILALTO products ordered on the WEBSITE. When the deadline falls on a Saturday, Sunday or holiday, the period is extended to the next business day. On receipt of goods returned by CUSTOMER pursuant to the provisions of Article L121-20-1 of the French Consumer Code, FILALTO then reimburses the purchase made as well as the costs for the initial delivery within a maximum period of 30 days of such receipt. Return costs of the products are borne by the CUSTOMER. To obtain a refund of the product, it is the CUSTOMER responsibility to take all necessary measures to ensure that it is delivered to FILALTO in the same conditions as initially shipped.
